ACDC / IronMan 2 Download and Win Competition: OPTUS PROMOTION - TERMS AND CONDITIONS

1. Information on how to enter and prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is limited to Optus Mobile, Optus Internet and Optus SMB customers ("Entrants") who are Australian residents (excluding Tasmanian residents). Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Optus Service Providers', MobileSat, and Optus Corporate customers are also ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. The Promoter, in its absolute discretion, reserves the right to verify the validity of Entrants, at any time, (including an Entrant's identity, age and place of residence) and to disqualify any Entrant who tampers with the entry process, including but not limited to, using techniques designed to avoid payment of WAP or GPRS costs. If there is a dispute as to the identity of an Entrant, the Entrant will be deemed to be the person in whose name the relevant Optus account is held. Errors and omissions will be accepted at the Promoter's discretion. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. All Entrants must be valid, active Optus customers with an account that is not overdue for payment at the time of the draw to be eligible to win.
5. Promotion commences 12:01am AEST on 07/05/2010. Final entries close 11:59pm AEST on 31/05/2010 ("Promotional Period").
6. To receive an automatic entry, Entrants must visit either: (a) www.optusmusicstore.com; (b) www.optus.com.au/music; or (c) www.optus.com.au/tones, and purchase any Music Track, True Tone, Polytone, Music Video or available Wallpaper where "ACDC" is featured as the Artist or in the Song Title during the Promotional Period.
7. Multiple entries are permitted; each purchase in accordance with Clause 6 above will constitute one (1) entry into the draw. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
8. All entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission.
9. All valid entries received during the entire Promotional Period will be entered into a random draw. The draw will take place at Optus Administration Pty Ltd, 1 Lyonpark Road, Macquarie Park, NSW 2113 at 3:00pm AEST on 01/06/2010. Winners will be contacted by the Promoter via phone and email. The winner of the Major Prize will have their name published in The Australian on 04/06/2010. The Promoter's decision is final and no correspondence will be entered into.
10. The first valid entry drawn from all entries received will win the Major Prize Pack valued at $902.85 consisting of: one (1) x ACDC Amp Boxset; (1) x Iron Man Tony Stark Heart Arc Reactor Prop Replica; one (1) Double Gold Class Movie Voucher to Event Cinemas; one (1) x Iron Man 2, Original Soundtrack CD.
11. Entries will then be split into the following State Groups (NSW, ACT, QLD, VIC, SA, WA and NT) and the first valid entry drawn from each group will win a Minor Prize Pack. Each Minor Prize Pack is valued at $102.95 each and consists of one (1) x Double Gold Class Movie Voucher to Event Cinemas; and one (1) x Iron Man 2, Original Soundtrack CD.
12. Total prize pool for each State Groups is valued at up to $1,005.80. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
13. If the winner of the major prize is under the age of 18 the major prize will be awarded to the winner's nominated parent or guardian.
14. If any prize or any element of a prize becomes unavailable for any reason beyond the Promoter's reasonable control, then a similar prize or prize element of equal or greater value will be awarded to the valid claimant in lieu.
15. Any costs associated with accessing the promotional website or mobile sites are the Entrants' responsibility and are dependent on the internet or mobile service provider used.
16. A draw for any unclaimed prizes may take place on 01/09/2010 at the same time and place as the original draw, subject to any written directions from a regulatory authority. Winners will be notified via phone and email. In the event of a winner of the Major Prize, their name will be published in The Australian on 03/09/2010.
17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
19. Entrants consent to the Promoter using the Entrant's name, likeness, image and/or voice (including photography, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
20. All entries become the property of the Promoter. The Promoter and third parties on behalf of Optus collect Entrants' personal information in order to conduct the promotion. By registering to myZOO/myBIZ account therefore entering the promotion, unless otherwise advised, each Entrant consents to the information they submit with their entry being entered into a database and the Promoter and its related bodies corporate may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Entrant including sending the Entrant electronic messages. All personal details of the Entrant provided by registering to myZOO/myBIZ account therefore entering the promotion will be stored at the office of the Promoter. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the Entrant. 21. As a condition of accepting a prize, the winner (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
